The agreement between you and flatmate.com when you use our website and services.

This Agreement governs the relationship between you — whether you are seeking a flatmate or looking for rental accommodation — and SuburbChooser.com Pty Ltd (flatmate.com). Please read it carefully before you register. You must be 18 years or older to use our services. By registering you agree to be bound by this Agreement.

1. Role of flatmate.com
- flatmate.com is a facilitator only. We are not an agent for any user of our Services or Website. Our role is to help you find accommodation or a flatmate.
- flatmate.com does not enter into any agreements on your behalf. You must enter into any rental, tenancy, or flatmate agreement directly with the other person.
- flatmate.com gives no guarantees about any person with whom you communicate or enter an agreement through the Services. We make no representations about a person's identity, ability to pay rent, or ability to provide accommodation on an ongoing basis, even where a user has a verified badge.
- flatmate.com will not get involved in disputes between users of the Services or Website. You are responsible for resolving disputes directly with the other party or through the relevant tenancy authority.
2. Your account & obligations
- You must be registered to place an advertisement on the Website, start a message thread, or use any paid feature.
- You must at all times provide information that is honest, correct and complete, including on the registration form, on your profile, on your listings, and when answering enquiries from other users. You will keep your details up to date while you remain registered.
- By providing information to us you agree to our use of it in accordance with our Privacy Policy.
- You must ensure any information, including photos, on your advertisement is accurate and kept up to date while visible on the Website. You must remove an advertisement as soon as possible after you have found a flatmate or accommodation.
- It is your responsibility to negotiate the terms of your engagement with any prospective flatmate or landlord, to make your own enquiries, check references, and satisfy yourself that the person or the accommodation is suitable.
- You must not use anyone else's account or allow anyone else to use your account.
- You must keep your login details — including your password — secure, and notify us if you think your account has been accessed without your permission.
- You must not use the Services or Website to engage in any unlawful, fraudulent, or harmful activity; to harass or abuse another user; to impersonate another person; or to collect personal information about other users for any purpose not authorised by this Agreement.
3. Fees & paid features
- There is no fee to register, post an advertisement, browse listings, or use the core messaging features on the free tier of the Service.
- flatmate.com offers optional paid plans (currently Verified, Premium, and Multiple Listings) which provide additional features. The Pricing page sets out the applicable fees.
- Paid features may be offered free of charge for a limited time during promotional periods. Free promotional access does not create an entitlement to the feature beyond the advertised period.
- Fees are payable in advance. Recurring subscriptions continue until you cancel from your Dashboard; you can turn Premium on and off as required.
- Refunds. Except as required by law (including the Australian Consumer Law), fees are non-refundable.

4. Messaging & video calls
New feature
- Message moderation. First-contact messages between users may be held for review before delivery. We may decline to deliver a message and may remove content from the Website if we consider it inappropriate, offensive, spam, or an infringement of another person's rights.
- Video calls are peer-to-peer. Video calls between members use WebRTC technology. Audio and video stream directly between your device and the other person's device and do not pass through flatmate.com servers. We do not record, store, or have access to call content.
- Your device, your data. You are responsible for the camera, microphone, network connection, and any data charges associated with your use of video calls. Call quality depends on your connection and your device, and flatmate.com makes no guarantee of call availability, connection success, or quality.
- Recording requires consent. You must not record (audio or video) any call made through flatmate.com without the clear, informed consent of the other participant. Doing so may be a criminal offence in your jurisdiction.
- Acceptable use. You must not use messaging or video calls to harass, threaten, defraud, or send unsolicited commercial material to another member; to share illegal content; to solicit payment outside flatmate.com's facilitated processes; or for any purpose unrelated to finding or offering accommodation.
- Signalling providers. Video calls rely on third-party signalling and TURN-relay providers (currently PeerJS and Metered/openrelay) to establish connections. Your use of video calls is also subject to those providers' terms, to the extent applicable.

5. ID Verification — powered by Didit
Optional
- ID Verification is optional. You can use flatmate.com without verifying your identity.
- When you choose to verify, you are redirected to our third-party partner Didit. Your use of Didit's service is governed by Didit's own terms and privacy policy, which you should read before starting the flow:
Didit terms of service → · Didit privacy policy → - flatmate.com receives only a verification status (verified or not verified) and basic confirmed details (such as name and date of birth). We do not receive or store images of your ID document or selfie.
- A verified badge is not a guarantee. It confirms that Didit successfully matched a government-issued ID to the person completing the flow at that point in time. It does not verify character, suitability, financial capacity, or any other trait. You must still exercise your own judgement about any person you deal with through the Services.
- You must not attempt to verify using anyone's identity other than your own, and must not use a verified badge to induce someone to rely on you in a way they would not otherwise.
- flatmate.com may remove a verified badge or suspend an account if we have reason to believe the verification was obtained fraudulently or the identity information is no longer accurate.

6. Property Hub
Shared household space
- A Property Hub is a private shared space for members of a household. Information you post in a Hub (chores, bills, rent records, shared calendar, house rules, agreements, messages, comments) is visible to all current members of that Hub.
- Hub admins can invite and remove members. If you are removed from a Hub, your historical contributions may remain in the Hub record for the remaining members, but your personal profile is delinked.
- We keep an audit log of actions taken within a Hub so members can see what has changed and when. You should treat Hub information as a shared household record, not as private personal data.
- Financial features of the Hub (rent tracking, bill splits) are for record-keeping only. flatmate.com does not process payments between Hub members and is not a party to any financial arrangement between you and your housemates.
- ICS calendar feeds use a signed token per property and are intended for personal use in your calendar app. You must not share or publish a feed URL.
- flatmate.com will not mediate disputes between Hub members. Content may be removed and accounts may be suspended for misuse of a Hub (e.g. harassment, illegal content, or using the Hub for any purpose unrelated to the household).
7. Our rights & moderation
- flatmate.com will use reasonable efforts to screen messages and content posted to the Website. We reserve the right not to pass on messages and to remove any content we consider inappropriate, offensive, misleading, or an infringement of a third party's rights.
- flatmate.com may remove any advertisement which, in our sole discretion, has been inactive for a reasonable period, is duplicated, or is misleading.
- flatmate.com may suspend or terminate your account, or remove your verified badge, if we reasonably believe you are in breach of this Agreement or that your use of the Service risks harm to others or to flatmate.com.
- We may update, limit, or discontinue features at any time. Where a paid feature is materially changed or withdrawn, we will use reasonable efforts to let affected users know in advance.
8. Termination
- flatmate.com may terminate this Agreement immediately on giving you notice if you breach any term of this Agreement or if, in our opinion, your continued use of the Services or Website will or may cause damage to flatmate.com's reputation or cause flatmate.com to breach any applicable law.
- You may stop using the Services at any time by deleting your account from the Dashboard.
- flatmate.com will not be liable to refund any fees to you if this Agreement is terminated by flatmate.com or by you, except as required by law.
9. Liability & indemnity
- You use the Services and Website at your own risk. Both are provided on an "as is" basis.
- Except as expressly set out in this Agreement, and subject to any terms, guarantees, warranties or conditions that by law may not be excluded, all representations, conditions, guarantees, warranties, terms and obligations implied by law or otherwise relating to the services provided by flatmate.com under this Agreement are excluded.
- To the extent permitted by law, flatmate.com will not be liable for any special, indirect or consequential loss or damage (including personal injury), loss of profit, or loss of opportunity arising out of or in connection with the provision of the Services by flatmate.com — whether at common law, under contract, in tort (including negligence), in equity, pursuant to statute, or otherwise.
- Without limiting the above, flatmate.com is not liable for: the conduct of any other user; the accuracy or quality of any listing; the outcome of any tenancy or flatmate arrangement entered into through the Services; the quality, availability, or security of video calls; the outcome of any ID Verification performed by Didit; or the actions of third-party service providers used to deliver parts of the Service.
- To the maximum extent permitted by law, the aggregate liability of flatmate.com under or in relation to this Agreement arising out of any act, omission or event (or series of related acts, omissions or events) will not exceed the dollar value of the fees paid by you to flatmate.com in the twelve (12) months immediately preceding the event giving rise to the liability.
- You agree to defend, indemnify and hold harmless flatmate.com, its subsidiaries, affiliates, employees, agents and independent contractors against any claims, damages, costs, liabilities and expenses (including reasonable legal fees) arising out of or related to your use of the Services or Website, your breach of this Agreement, or your violation of any law or the rights of any third party.
10. Content & intellectual property
- All content on the Website that is not posted by users (including the flatmate.com name, logo, design, software, and copy) is owned by SuburbChooser.com Pty Ltd or its licensors, and is protected by copyright, trade mark and other intellectual-property laws.
- Content you post (listings, photos, profile content, messages, Hub content, reviews) remains your property. You grant flatmate.com a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, modify (for formatting purposes), and distribute your content for the purpose of operating and promoting the Services.
- You warrant that content you post is yours to post and does not infringe any third party's rights.
- You must not scrape, mirror, or systematically extract data from the Website, and you must not use automated tools (including bots or scripts) to access the Services except where we have expressly permitted it.
11. General
- This Agreement is governed by the laws of New South Wales, Australia, and the parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New South Wales.
- If any part of this Agreement is found to be illegal or unenforceable, it will be severed and the remaining provisions will continue to apply.
- flatmate.com may amend this Agreement from time to time. Material changes will be posted on the Website with a new "last updated" date. Continued use of the Services after a change takes effect constitutes your acceptance of the amended Agreement.
- The failure of either party to enforce, or the delay by either party in enforcing, any of its rights will not be deemed a continuing waiver or a modification of this Agreement.
- This Agreement, together with the Privacy Policy, contains the entire agreement between the parties with respect to its subject matter.
